Abstract
:
This study aims at explaining the concept of the crime of breach of trust in the Saudi system and the Egyptian law, identifying the similarities and differences between them and reviewing the methods used in imposing penalties resulting from the crime according to the new system issued by the royal decree No. (M / 79) dated 9/10/1442 AH corresponding to 4/22/2021 AD, and the Penal Code No. (58) of 1937 AD according to the latest amendment issued on November 20, 2021, AD. It also explained its pillars and the criminal liability of the perpetrator of the crime and the crimes attached to it. Moreover, it discussed the penalties resulting from the crime of breach of trust in the Saudi system and Egyptian law. To achieve that, the inductive and comparative approach was used in this study. The study revealed the following results: 1) establishing criminal liability for the crime of breach of trust in both systems requires the perpetrator to commit any of the criminal acts stipulated in both systems with the presence of criminal intent. 2) The Saudi regulator did not include crimes attached to the crime of breach of trust, unlike its counterpart, the Egyptian legislator, which added three more crimes to the crime of breach of trust. The study recommends that the Saudi regulator should add all articles that criminalize the breach of trust in various other systems to the anti-financial fraud and the breach of trust system to be more general and comprehensive system. It also recommends to the Egyptian legislator to criminalize and punish whoever attempts to commit a crime of breach of trust and to impose complementary penalties for the crime of breach of trust following his Saudi counterpart.
