Abstract
:
The Study problem: The problem of this study lies in the many forms and models of crimes and violations committed by a service provider and the wide cases of fraud and deceit through the electronic network, which necessitates the response to confront these forms and models, to select the suitable penalties by shedding the light on the regular stipulations mentioned in the electronic commerce law and other laws related to presentation and analysis. Moreover to review different kinds of crimes and violations perceived to be committed by a service provider as well as the regular penalties and to what extent they are effective. The Study Objective: The current study tackled some objectives, the most important were; to identify the elements of electronic crime subject of service provider's liability, to clarify its material and moral element and to review the different kinds of crimes and violations perceived to be committed by a service provider and regular penalties of service provider violations and crimes in order to reach solutions that can fill some of regular gaps. The Study Method: The current study adopted the analytical approach. The most important results reached: E- commerce is considered a form of electronic transactions with a special mean and not a type of trading . there were a conflict of legal and jurisdictional competence pertaining to violations committed by service provider in the field of e-commerce as they are subject to more than one law. There were more than one judicial body in addition to the committee for e-commerce violations resolution regarding to imposing penalties. The most important recommendations: The researcher recommends the necessity to organize jurisdiction process to consider all violations and crimes of e-commerce law at special circulars in courts to consider these crimes. Unification the additional penalties among e-commerce law and other related laws and to stipulate that they are mandatory additional penalties .
