The study addresses the expiration of the patent in the Saudi system, the Egyptian law, and the international agreements like Paris Convention for the Protection of Industrial Property, and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). That is through studying what the patent is, the expiration of the patent, giving up the patent, making no use of the patent, and not paying the fees and the patent nullification.
This study depends on the analytic approach which compares between the Saudi system, the Egyptian Law, and the international treatment (Paris and TRIPS). Also, the study tries to decide the shortage and distinction aspects in both regulations in order to give responses to the study queries.
This study has proved that there are several similarities and differences in the Saudi arbitration, the Egyptian law, and the international agreement (Paris and TRIPS).
This study makes some recommendations which we can state some of them. First, it suggests that the Saudi regulator and Legal person (It is the legal person such as companies and etc…) to set that any foreigner has the right to apply to get the patent for being conforming to the Egyptian law and the provision of Paris agreement and TRIPS on the basis of principle of the national treatment and the prior care country. Second, it suggests that the Saudi regulator to set the international depletion and the parallel importing due to its big economic importance, especially in the field of medicines industry to conform to the international agreements and the Egyptian law. Third, we suggest that the Saudi regulator to set the acts that is considered such illegal contest in order to be conforming to the international agreements (TRIPS) and the Egyptian law. |
